Public Offer

on concluding a service agreement

1. General Provisions

This Public Offer (hereinafter — the "Offer") is an official proposal by a self-employed individual (hereinafter — the "Contractor") to any interested party (hereinafter — the "Customer") to enter into a paid services agreement in accordance with Article 437 of the Civil Code of the Russian Federation.

The Offer shall be deemed accepted by the Customer when the Customer performs the actions specified in Section 2 of this Offer, which shall constitute full and unconditional acceptance of all terms of this Agreement.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the Customer with access to additional game functionality, in-game items and currency in the mobile application "Elder Heroes" (hereinafter — the "Services"), and the Customer undertakes to pay for them.

2.2. The name, quantity, price and procedure for providing the Services are determined based on the information displayed in the mobile application at the time of purchase.

2.3. The Agreement is concluded by acceptance of this Offer, expressed by the Customer's payment for the Services through the built-in payment functionality.

3. Rights and Obligations of the Parties

3.1. The Contractor undertakes to:

• Provide the Services in accordance with this Offer;
• Ensure the Customer's access to the purchased in-game content after payment;
• Process the Customer's personal data in accordance with the legislation of the Russian Federation and use it exclusively for the performance of this Agreement.

3.2. The Customer undertakes to:

• Provide accurate information when making payments;
• Not use purchased in-game items/currency for purposes that contradict the legislation of the Russian Federation;
• Pay for the Services in full.

3.3. The Customer has the right to:

• Receive the purchased in-game content;
• Request a refund in cases and according to the procedure established by the legislation of the Russian Federation and this Offer.

4. Price and Payment Procedure

4.1. The cost of the Services is determined in accordance with the prices specified in the "Elder Heroes" mobile application at the time of purchase.

4.2. The prices for the Services range from 79 (Seventy-nine) to 5,490 (Five thousand four hundred ninety) Russian Rubles, inclusive. The specific cost of the purchased in-game content (package, bundle, currency, etc.) is displayed to the Customer on the payment confirmation screen.

4.3. The Contractor reserves the right to change the prices for the Services and their range unilaterally. The new prices come into effect from the moment they are published in the mobile application.

5. Refund Policy

5.1. The Customer has the right to request a refund within 7 (seven) calendar days from the date of payment, provided that the supplied in-game content (currency, items, bonuses) has not been used.

5.2. In case of activation or use of the in-game content, refunds are not provided.

5.3. Refunds are processed in accordance with the procedure established by the legislation of the Russian Federation, to the same payment card or other source from which the payment was made.

6. Confidentiality

The Parties undertake to maintain the confidentiality of personal data and other information obtained in the course of performing this Agreement, in accordance with Federal Law No. 152-FZ "On Personal Data".

7. Force Majeure

The Parties shall be released from liability for full or partial non-performance of obligations under this Agreement in the event of force majeure circumstances confirmed by authorized bodies.

8. Liability of the Parties

8.1. The Contractor shall not be liable for the inability to provide the Services in the event of:

• malfunction of the Customer's equipment or software;
• actions/inactions of communication operators and/or third parties;
• unlawful actions of the Customer.

8.2. The Customer shall be responsible for the accuracy of the information provided and for the security of their accounts.

9. Term of the Offer

9.1. This Offer comes into effect from the moment it is posted on the Internet at the address specified by the Contractor.

9.2. The Offer is valid indefinitely until withdrawn by the Contractor.

9.3. The Contractor has the right to change the terms of this Offer unilaterally by publishing a new version.
